State Supreme Court upholds ruling favoring Broulim’s
The Idaho Supreme Court rejected a man’s personal injury lawsuit against Broulim’s Supermarket.
Gary Holdaway took his case to Idaho’s highest court after District Court Judge Gregory Moeller ruled in favor of the regional grocery chain.
On May 4, 2009, Holdaway was struck by a car while riding his bike and had screws implanted in his leg, the Idaho Supreme Court said. On May 25, 2009, a door at Broulim’s closed on his injured leg and damaged one of the screws, Holdaway said. He wanted $100,000 to pay for a new surgical procedure.
The Supreme Court upheld Moeller’s ruling, saying Holdaway had failed to present admissible evidence that showed the door had caused his injury.
