District 93 board chair responds to contract allegations

A letter sent to the state suggest Bonneville School District 93 and Hughes General Contractors broke the law.

However, Hughes General Contractors says the letter sent by the Idaho Association of General Contractors is a lie.

The attorney for the company asked Idaho AGC to correct the letter for the record but says he hasn’t heard back as of Wednesday night.

School board chairman Brian McBride says when the board voted to approve the proposal there was no mention of a license issue.

The three page letter was sent, signed and delivered to the state contractors license chairman.

It says recent actions between Hughes General Contractors and District 93 violates a number of Idaho statutes.

The Idaho AGC claims the contractor did not have it’s state public works license at the time it submitted the bid.

It also says a construction manager license was not obtained in time.

Hughes General Contractors applied for a construction manager license on Feb. 11.

That’s one day after the school board voted in favor of accepting the company’s proposal.

“We have our attorney’s looking at the contract. In order to be valid it has to go through the attorney’s. They’re looking at the accuracy of the information…licenses and all those things that would help us in finding out whether or not we can stay with Hughes or whether we need to select a different company,” said board chair Brian McBride.

Hughes General Contractors attorney tells Local News 8/KIDK Eyewitness News it did have the public works license on Jan. 19.

The attorney says they gave the district the certificate verifying their public works license Jan. 20.

The attorney also says under Idaho law a construction manger license is not required until someone is acting as a construction manager.
Hughes General Contractors will be in Boise Thursday to dispute any claims of wrong doing to the state licensing board.

The company says it’s a misunderstanding in the contractor community of what the law requires.
