Narvaez-Zamora given 32 year sentence for rape of pre-teen girl

Marcos Narvaez-Zamora is sentenced to 10 years fixed, and jail time for the rape of a 12-year-old girl.

Narvaez-Zamora was sentenced for the crime Tuesday in Teton County. He pleaded guilty to the charges in December of 2015.

The victim at the time of the rape was 11 years-old and became impregnated.

A psycho-sexual evaluation was taken by Narvaez-Zamora, and came out inconclusive pertaining to Narvaez-Zamora’s past sexual history.

The psycho-sexual evaluation focuses on one’s sexual history, which includes the exploration of sexual development, attitudes, fantasies, and adjustment.

Narvaez-Zamora whom only speaks Spanish had a translator sitting beside him in court Tuesday, Narvaez-Zamora is an illegal immigrant from Mexico and if granted parole for good behavior and after serving his 10 years he could face the federal immigration authorities which then could deport him.

Deputy Prosecutor for Teton County Chris Lundberg said being deported proposes a concern.

“If someone is removed from the country we no longer have jurisdiction over that person, so that person could then return to a community outside this country, there is no supervision over them or registration. There could potentially be new victims,” Lundberg said.

Narvaez-Zamora was given a sentence of 10 years fixed as well as an additional 22 years indeterminate jail time. Judge Greg Moeller also ordered that Narvaez-Zamora must register as a sex offender for life, give a DNA sample along with thumb print.

When Moeller asked Narvaez-Zamora if he had anything to say before hearing his sentence, Narvaez-Zamora said he apologized for his wrong doing.

“I understand my mistake and I understand the rules,” Narvaez-Zamora.

Moeller took into consideration when giving the sentence that prior to the crime Narvaez-Zamora had no prior convictions or had any issues with substance abuse.

During sentencing judge Moeller explained how serious the case was.

“This is the rape of young girl. The facts are heartbreaking. This is one of the worst cases I’ve heard in my time of being an attorney and judge,” Moeller said.

Moeller also mentioned the lack of remorse Narvaez-Zamora had for the victim.

“Not once do you (Narvaez-Zamora) say your sorry to the victim, instead you protest that the victim wanted it to happen,” Moeller said.

“Let me tell you Narvaez-Zamora, no 11 year-old dreams of being raped and getting pregnant,” Moeller said.

He also said, “You were put in a position of trust and you exploited this young girl, you are an opportunist, you frequently and systematically sexually abused this child.”

Moeller imposed a fine of $10,000, court costs of $165.50, a penalty of $375 to be paid to Victim Relief Fund and a civil penalty payable to the victim in the amount of $5,000. He was also ordered to pay full restitution.

Narvaez-Zamora has 42 days from from Tuesday to file an appeal and 120 days to file a motion of a reduction or correction.

The prosecution was originally seeking a life sentence for the crime, but Moeller denied the request. Had Narvaez-Zamora been a repeat offender, the sentence would have been appropriate.

“It’s a case where there’s no way to fix what happened, I think Moeller did an excellent job with the sentence,” Lundberg said.
