Francke sentenced for sexual exploitation and battery of a child

Phillip Francke appeared in court on Tuesday morning to be sentenced for two counts of sexual exploitation of a child and one count of sexual battery of a minor. Francke pleaded guilty to the charges in December as part of a plea deal that dropped 9 similar charges.

For the two charges of sexual exploitation of a child, Francke was sentenced to four years fixed, six years indeterminate in prison. On the charge of sexual battery of a minor, he was sentenced to four years fixed, ten years indeterminate.

Although the victims were not present in court, Francke still addressed the court.

“I’m deeply sorry for what I’ve done. I was not in the right frame of mind,” Francke said, before the sentencing.

“I’m not sure how remorseful you really are,” Judge Naftz said, recalling Francke’s history. Naftz also cited Francke’s psychosexual evaluation during the sentencing which shows Francke is still a high risk to society and needs more treatment & jail time.

In April, during the time he faced these charges in Bannock County, he had been serving jail time in Caribou County for similar charges – 16 felony counts of enticing a child through the Internet, some as young as 11, 12, and 13 years old.
