Group Seeks Restraining Order Against City Of Idaho Falls

Calling itself the Alliance for Property Rights and Fiscal Responsibility, a group of Bonneville County property owners is seeking a temporary restraining order against the city of Idaho Falls. They’re challenging Idaho Falls Power’s authority to condemn right of way for construction of the 161-kilovolt North Loop Transmission Line.

In a news release, the Alliance contends property owners were given until March 9 to accept the city’s purchase proposals or face the threat of eminent domain and condemnation.

The group claims its suggestions for alternate routes were dismissed by HDR, the engineering firm hired by the city to work on the project.

A court hearing is pending before 7th District Judge Richard St. Claire.
