Jackson council passes emergency moratorium on adult businesses
The Jackson Town Council has adopted an emergency ordinance and enacted a 180 day moratorium on the acceptance or consideration of any adult entertainment business.
City Clerk Olivia Goodale said there are no applications for any such business currently on file. She said the action was aimed at bringing the town’s ordinances into compliance with constitutional requirements.
Town lawyers said existing laws were adopted in 1926 and are in conflict with the constitution. Recent law has upheld regulations of such businesses if they are based upon studies of secondary effects in certain neighborhoods or zoning districts and not just on content of the operation.
As part of the action, town staff will review and report on studies reviewing the impact of adult entertainment businesses on the community.
