Judge keeps alive newspaper case seeking BYU police emails

A judge is keeping alive a newspaper open-records lawsuit aimed at obtaining Brigham Young University police emails for a probe of allegations that sex assault victims who made honor code complaints were improperly investigated. A university spokeswoman said Monday that BYU intends to provide more information to 3rd District Judge Laura Scott, following her ruling on Friday. The judge denied BYU’s bid to dismiss the Salt Lake Tribune lawsuit. The Tribune reports it wants to review emails between campus police and the university’s honor code and Title IX offices. BYU argues that because it’s privately owned by the Mormon church, campus police aren’t subject to state open records law. The Tribune argues that BYU police are like any other law enforcement agency, and their records are public.
