Officer involved shooting report released

The Bonneville County Prosecutor’s Office has released the full review of the Eastern Idaho Critical Incident Task Force investigation of an officer involved shooting incident in Idaho Falls.

The Twin Falls County Prosecuting Attorney investigated the January 23, 2018 shooting death of Shane McVey at the intersection of South Boulevard and Elm Street. Prosecutor Grant Loebs said he found “insufficient evidence to support a criminal charge against any law enforcement officers.”The report reveals that Officer Earl Laughter gave McVey verbal commands to stop and show his hands. McVey refused the commands and advanced toward the officer. It indicates McVey suddenly charged towards the officers, brought his hand up, aimed at Officer Laughter and fired a stream of pepper spray at the officer. According to the report, Laughter feared he would be incapacitated by the pepper spray and that McVey would overtake him and try to take his gun, which was already out of the holster.

Laughter fired one round from his department-issued Glock 17, 9 mm pistol, striking McVey. Toxicology reports from a subsequent autopsy indicated the presence of methamphetamine and amphetamine in McVey’s blood and need tracks on his arms.

Loebs released the report to the Bonneville County Prosecutor’s Office March 7.

The report has been under internal review by the Idaho Falls Police Department’s “Use of Force Review Board” and Chief Bryce Johnson.
