Judge to hear arguments in Idaho Falls sperm donor lawsuit

A federal judge will hear arguments later this month in a lawsuit brought by a woman against the fertility doctor who she says fraudulently used his own sperm to artificially inseminate her mother.

U.S. District Judge David Nye is scheduled to hear arguments in a motion to dismiss the lawsuit filed by Dr. Gerald Mortimer and his former medical practice on Aug. 30 in Pocatello, Idaho.

Kelli Rowlette and her parents Sally Ashby and Howard Fowler filed the lawsuit against Mortimer earlier this year, contending the doctor committed medical malpractice, breach of contract and fraud when he carried out the artificial insemination procedures on Ashby over several months in 1980. The family contends Mortimer told them he’d use an anonymous donor but used his own genetic material instead.

Mortimer has denied any wrongdoing.
