Court proceedings continue for former BMH IT Director

Former Bingham Memorial Hospital IT Director Jack York did not appear for a scheduled status hearing before District Judge David C. Nye in Blackfoot Friday morning.

York’s attorney Ann Taylor told the court she didn’t think York needed to be there.

York has been charged with three felony counts of interception of wire or oral communication. He was indicted by a Bingham County Grand Jury in June.

Appearing by telephone, Deputy Idaho Attorney General Krista Howard told Judge Nye that another felony charge of grand theft will be filed against York later this month. There was no description of what that charge was for or if it was related to the wire tapping charges.

York is scheduled to appear on November 27 for arraignment on the grand theft charge. Further proceedings on the wiretapping charges were scheduled for January 17.

During a preliminary hearing September 20, York stood silent on the allegations. He is accused of setting up devices to record telephone calls in Dr. Robert Rosin’s office at the hospital. According to the indictment, the wire tap was set up between June 2009 and August 2010.

Bingham Memorial CEO Louis Kraml was indicted by the same grand jury. As part of a plea bargain, Kraml entered an Alford plea to a charge of stalking in the second degree, a misdemeanor, in August.

An Alford plea means the defendant is asserting his innocence, but concedes he could be found guilty based on the evidence.

Kraml was sentenced to 100 hours of community service, one year probation, and a $1,000 fine. A 30-day jail sentence was suspended.
