Preliminary hearing delayed in murder case

A preliminary magistrate court hearing for Josephine Bobbie Theboy has been delayed to Sept. 26. She is charged with the first-degree murder of 47-year-old Martin Anderton. Theboy is also charged with felony robbery and burglary.

Anderton was found dead at the scene of a May 7 fire at 12474 Cherry Lane in Bannock County near the Shoshone Bannock Indian Reservation. Prosecutor Stephen Herzog believes the fire was started at some point during a robbery and burglary.

According to court records, Magistrate Judge Scott Axline ordered the delay Wednesday after learning an autopsy of Anderton’s body in Utah has not yet been performed.

Theboy is being held on $500,000 bond.
