Blackfoot man indicted for unlawful possession of firearms

Matthew G. Burgett, 24, of Blackfoot, Idaho, was indicted today by a federal grand jury sitting in Pocatello for the unlawful possession of firearms, U.S. Attorney Wendy J. Olson announced.

The indictment alleges that on or about September 24, 2015, in the District of Idaho, the defendant, Matthew Burgett, having been adjudicated as a mental defective and committed to a mental institution, did knowingly possess two firearms in violation of Title 18, United States Code.

The charge of Unlawful Possession of a Firearm is punishable by up to 10 years in prison, a maximum fine of $250,000, and not more than three years of supervised release.

The case is being investigated by Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) the Federal Bureau of Investigation (FBI), the Bingham County Sheriff’s Office, and the Blackfoot Police Department.

An indictment is a means of charging a person with criminal activity. It is not evidence. The person is presumed innocent until proven guilty beyond a reasonable doubt in a court of law.
