Francke pleads not guilty to child pornography and sexual battery

Phillip Francke was back in court Tuesday for his arraignment.

Francke is charged with ten counts of child sexual exploitation, or child pornography. He’s also charged with two counts of sexual battery with a minor, age 16 to 17.

In court Tuesday, Francke entered a plea of not guilty to all charges.

However, his lawyer said in court that they are currently working on an agreement with the state. If an agreement is reached, Francke would go back before a judge for sentencing.

If no agreement is reached, Francke’s case will continue to trial.

As of right now, his trial is scheduled for Dec. 13.

Based on the charges, Francke is looking at a maximum of 150 years jail time or a $200,000 fine.

He is already serving jail time for charges in Caribou County after being sentenced last month.

He was sentenced to two years determinate and eight years indeterminate jail time on three charges of enticing a child through the internet.

Francke also currently has a separate trial pending on a stalking charge in Bannock County.
