Former Jefferson County Sheriff wins partial victory from Idaho Supreme Court

Former Jefferson County Sheriff Blair Olsen won a partial victory in his appeal of his conviction on three counts of misuse of public funds.

In a decision issued Wednesday, the Idaho Supreme Court affirmed Olsen was guilty to one count. However, the court remanded the case back to 7th District Court to vacate his conviction on two of the three counts.

Olsen argued he only made one decision to permit his wife to use a county-issued cell phone.

The court determined that while the court could aggregate the charges, the jury must decide whether violations were committed or were part of a common scheme or plan.
