Family of Utah man killed by officer sues police department

SALT LAKE CITY (AP) — The family of a Utah man who was shot and killed by a police officer are suing the police department for his death.

The Salt Lake Tribune reports the family of Bryan Peña-Valencia is claiming that Omar Flores, an officer with the Unified Police Department in the Salt Lake City area, had no reason to chase after and shoot Peña-Valencia last March.

Flores shot the 28-year-old after he and another officer chased him into a backyard, when police say the man reached for his waistband.

The lawsuit says that Peña-Valencia was complying and that evidence will reveal Flores shot him five times while he was on the ground.
