Hearing continued for Swainston

POCATELLO, Idaho (KIFI) - A court hearing for a woman and her son will have to wait.

The two are charged with taking an underage girl across state lines to get an abortion.

Our cameras found Rachel and Kadyn Swainston outside the courtroom before a scheduled hearing Tuesday afternoon. 

Rachael Swainston waived her right to a speedy trial Tuesday, so her public defender has more time to prepare her case.  

Her preliminary hearing is now scheduled for Dec. 5. 

The Bannock Count yProsecutor's Office says the two took a teenage girl out of state without her parents' knowledge and did not allow her to talk with her parents.

Kadyn Swainston is also facing rape charges.
