Fort Hall man pleads guilty to assault with a dangerous weapon

A Fort Hall man pleaded guilty Wednesday to assault with a dangerous weapon in U.S. District Court at Pocatello.

Adam Diaz, 21, pleaded guilty to an indictment filed Sept. 25, 2012.In the plea, Diaz admitted he pointed a gun at a victim who was sitting in a vehicle near a Fort Hall residence Jan. 28, 2012.The U.S. Attorney’s Office said Diaz fired a shot, which missed the victim, but struck a window of the vehicle.

Diaz later told Fort Hall police he intended to injure the victim when he pointed the gun at him, according to a news release from U.S. Attorney Wendy J. Olson. Police recovered the gun, a Keltec .380 caliber handgun.

When Diaz appears for sentencing before Chief U.S. District Judge B. Lynn Winmill in Pocatello on May 28, he will face up to 10 years in prison, a maximum fine of $250,000 and up to three years of supervised release.
