Fort Hall man pleads not guilty to assaulting an officer

Standing before a district court on Monday, Kevin Toane plead not guilty to both counts he has been charged with after he was shot during a late-night chase involving one Bannock County Sheriff’s deputy.

Toane, 33, is charged with eluding a police officer in a motor vehicle as well as assault and battery with an enhancement of using a deadly weapon.

Both charges are felonies.

In November, Toane tried ramming a deputy’s car after law enforcement ended a high-speed pursuit which started because he was suspected of a hit-and-run.

Toane was taken to Portneuf Medical Center where he was treated for his wound before being flown to the University of Utah Medical Center.

Bond has been posted at $50,000.

The Bannock County prosecutor’s office said his next court date has not yet been set, but expects it will take place in April.
