Judge terminates injunction regarding Idaho State Tax Commission determination D91 levy was “unlawful”

IDAHO FALLS, Idaho (KIFI) - We have an update on the Idaho Falls School District 91 levy dispute between the Idaho State Tax Commission and the district.

An Ada County judge has terminated a temporary injunction against the Idaho State Tax Commission.

According to Bonneville County prosecutor Randy Neal, the injunction prevented the commission from notifying Bonneville County that District 91's most recent plant facilities levy was unlawful.

69.9% of voters passed the plant facilities levy on May 16.

The levy is a $3.3 million-a-year, 10-year plant facilities levy.

The state attorney general says school districts can't have concurrent plant facilities levies, which forces the Bonneville County prosecutor to be involved.

Neal will be holding a public forum Tuesday at 7 p.m. in the Community Room at Smith Chevrolet to answer the public's questions.
