Confusion brews over who can close roads

When a traffic accident occurs, who has the power to shut down roads? Idaho State Police said current laws don’t make it clear that it has the authority to do this.

Lt. Col. Kedrick Wills said several years ago the agency was sued for blocking traffic during an accident and a judge ruled against ISP.

ISP now hopes to introduce legislation that would grant them the power to close roads when deemed necessary.

“The issue with that is we just need to clean up the legislative process to make it very clear, in emergency situations, that ISP would be able to have that authority,” said Wills.

ISP hopes to introduce the legislation in the upcoming legislative session.
