Man ticketed for plowing street fighting ticket

Mitch Fisher’s has gone national.

In January, he was given a ticket for a little more than $200 for plowing his and his neighbors’ driveways.

Now, he his fighting the ticket in court.

He has had four court appearances. He said the first time, the court couldn’t find the law that Fisher supposedly had broken. The second time they did. Officers claim he broke the law that prohibits pushing dangerous material into the roadway.

According to the Pocatello Police Department, that’s exactly why he was given the ticket in the first place – because he was plowing the snow out into the street.

But Fisher said he was piling it in front of his own driveway.

Fisher’s third appearance was a pre-trial hearing for discovery, but no evidence was presented.

The fourth appearance was Monday, during which police presented a picture of what Fisher had plowed as evidence.

Now Fisher will go to trial on Feb. 27. Since it’s an infraction, his trial will just be before a judge – no jury. Fisher said he has witnesses and he plans to present his side of the story.

He said he has several elderly neighbors and he always plows their driveways for them.

So he said that’s why he’s fighting the ticket – on principle. He feels the situation is pretty unfair and he shouldn’t be given a ticket for doing a good deed.

“I just think it’s a waste of tax money,” Fisher said. “It’s just crazy that’s it’s going all this way and I know it’s being spent on prosecutors and court appointments and it’s just a silly thing. I was just trying to help my neighbors and I didn’t expect any of this.”
