Man ticketed for plowing neighbors driveways wins case
The Pocatello man who was ticketed for plowing his neighbors’ driveways won his case this week.
Mitch Fisher was issued a $206 ticket when plowing out his neighbors. Police said he broke a law against pushing dangerous materials into the street. Fisher decided to fight the ticket.On
On Monday, a judge dismissed the ticket. Fisher said the statute that was cited only spoke about not pushing materials generate on one’s property onto the street, such as sticks or trees.
Fisher said snow was not specifically mentioned. Also, the snow did not originate on Fisher’s property, so the statute really did not fully apply and the ticket was dismissed.
Fisher said he was still charged $75, which he was told was some sort of bond fee. But he said he would gladly pay that if it allows him to continue helping his neighbors.
“It’s gone and I’m quite happy with it,” he said. “I think it turned out pretty good but you know, the real thing here is that these are disabled people. All three of these are elderly people – 78 years old is the youngest one – they need help with this stuff in the winter time. We need to have some kind of program that lets people do this for them without being in trouble.”
Fisher said he never expected it to turn into such a mess, but he fought the ticket on principle. He said he has nothing against the Pocatello Police Department and he appreciates what they do.
“I think those guys do a great job,” Fisher said. “They have a heck of a hard job to do and you can’t please everyone and I realize that.”
