D91 buildings can be used for political caucuses
IDAHO FALLS, Idaho (KIFI) - Idaho Falls School District 91 announced after consultation with legal counsel, it will share its school buildings with political caucus groups.
Idaho Falls School District 91 received several requests to use D91 buildings for caucuses, so the district sought legal counsel when first approached about the issue. The initial counsel the district received was that public property could not be used to “advocate for or against a candidate or a ballot measure . . .” (Idaho Code 74-604).
In light of the Attorney General’s opinion on the subject, the district on Friday afternoon asked legal counsel to review the matter again. After the second review, the district’s attorneys advised D91’s buildings can be used by political parties as long as the parties rent the buildings, provide liability insurance, and follow all district protocols related to building usage.
The district will be reaching out to the political parties with this update, along with building rental information.
