Man Gets 5 to 15 Years In Prison For Shaking Baby
An Idaho Falls man was sentenced to five to 15 years in prison Thursday after he shook a baby, which led to the child?s death.
In January 2010, Mexican national Mauricio Cando-Franco, 26, was babysitting the baby girl of his girlfriend, Michelle Cook, when the girl?s grandmother stopped to see her. She told police the 6-month-old child, Ziola, looked limp. She suffered extreme brain damage and a detached retina, injuries common with shaking a child.
Cando-Franco was initially charged with first-degree murder by aggravated battery, but the charge was reduced to voluntary manslaughter in a binding plea agreement.
Sixth District Judge Jon Jonathan Schinderling accepted the plea agreement.
?There isn?t any other case that makes my heart ache like these cases do,? said Schinderling.
After Cando-Franco serves his sentence, he will be deported to Mexico.
