Rexburg landlord assault trial ends in hung jury

An eastern Idaho jury has failed to reach a verdict in the case of a Rexburg woman accused of pulling out a handgun during an argument with her landlord.

The Rexburg Standard Journal reports (http://bit.ly/QTPlCM ) jurors deliberated for more than five hours before declaring an impasse late last week in the case of 33-year-old Melissia Ann Kennedy. She was charged with aggravated assault following the January confrontation with her landlord.

Madison County prosecutors argued Kennedy was aware of her landlord’s pending home inspection and overreacted during an argument with the man, Edward Milton. Kennedy’s defense attorney countered that she felt threatened by Milton when she drew her weapon on the front porch of the residence.

An October status hearing has been scheduled to determine whether the case will be retried.
