Video Details Emerge In Moreno Brothers Murder Case
On Tuesday afternoon, the two brothers accused of beating a man to death outside of a popular Pocatello bar learned the judge denied their request to decrease their $1 million bond or to be released on their own recognizance.
That drew elation from the more than 70 people who came out to support the family of Nathan Tad Richardson, who had died after he was allegedly struck by Gabriel Moreno outside of the Center Street Clubhouse in June.
Both Gabriel and his brother Anthony Moreno are being held on $1 million bond, each.
Earlier in July, the brothers hired a private attorney out of Blackfoot to represent them in this case.
Defense attorney Justin Oleson has represented them before on past, unrelated charges that were later dropped.
During Oleson’s plea to the judge to grant the brothers a decreased, reasonable bond amount, he drew on evidence submitted in the form of a video that was recorded the night of the incident and posted on a social media site before being deleted.
He said Anthony recorded the debacle, claiming the video indicates Richardson instigated the fight, and ended with Gabriel punching him once before he hit his head on the ground.
“The original allegations just aren’t true,” Oleson said. “This was a consensual bar fight you see all over the world, the nation, and here in Bannock County.”
However, the state argued the defense only gave partial description of the video which shows Gabriel repeatedly punching Richardson, and then later bragging about the incident.
“These two are known for getting into bar fights,” prosecuting attorney Ashely Graham said, also stating the brothers had been kicked-out of that bar before.
Oleson told the judge, this is a case of ‘involuntary manslaughter’ instead of the second degree murder charges the brothers currently face.
The brothers are expected back in court for their preliminary hearing on August 8, where they could enter their pleas.
