Tiffany Petersen’s ex-husband also facing charges for sexual abuse of first-grader
UPDATE 4:00 p.m.: David McGarry, the ex-husband of Tiffany Petersen, did not enter a plea during his video arraignment Thursday.
McGarry, along with his ex-wife, is charged with rape and lewd conduct. He was already serving time in Jerome County before being extradited back to Bannock County this week. Since McGarry was indicted by a grand jury, there is no bond.
Judge Paul Laggis released McGarry on his own recognizance Thursday. He is on felony probation until 2022 for other charges.
McGarry will be back in court Monday morning when he will stand before Judge Stephen Dunn, the same judge his ex-wife faced.

Another person is set to be arraigned at the Bannock County Courthouse Thursday, pertaining to the same alleged abuses as Tiffany Petersen. Petersen’s ex-husband, David McGarry, is set to stand before Judge Paul Laggis, via video, at 1:30 p.m.
McGarry faces the same rape and lewd conduct charges as Petersen, who pled not guilty before Judge Stephen Dunn on Tuesday.
McGarry and Petersen are accused of sexually assaulting one of Petersen’s first-grade students from 2008 to 2009.
Both parties could face life in prison if found guilty under these charges.
