Ohlson appeals murder sentence

After pleading guilty to murder last February, Erik Ohlson wants his jail sentence reduced. Ohlson was sentenced in May for the shooting death of Jennifer Nalley and her unborn fetus at a home near Driggs.

In May, Judge Bruce Pickett sentenced Ohlson to a fixed 25-year term for Nalley’s death and a concurrent 10 to 15 years for the death of the unborn baby.

Ohlson has already appealed his case to the Idaho Supreme Court. That case is pending.

On Tuesday, August 6, Judge Bruce Pickett granted Ohlson’s request to reconsider his sentence in the case.

Under “Rule 35,” a defendant has 120 days to seek a reduction in sentence. Teton County Prosecutor Billie Siddoway explained that, because of the deadlines, the motion process can run at the same time as his Supreme Court appeal.

Judge Pickett scheduled a hearing August 30 to consider that sentence appeal.
