Settlement reached for Horsethief Canyon fire damage

James Anderson of Jackson has agreed to pay $2.925 million in damages that were caused by the Horsethief Canyon fire that began September 8, 2012 in Jackson.

United States Attorney Christopher A. “kip” Crofts said the fire started approximately five miles south of Jackson and spread to the Little Horsethief Canyon area. The fire burned 3,373 acres.

The U.S. Forest Service originally wanted to collect $6.3 million from the 77-year-old man accused of accidentally starting the wildfire that threatened the town of Jackson, Wyo.

Investigation confirmed the blaze originated near a metal burn barrel located on Anderson’s property. Anderson had used the barrel to burn debris on the morning of the fire. The barrel was rusted through at the base creating several holes that allowed ash to escape and ignite vegetation. The fire soon spread out of control to the surrounding area.

Crofts said the United States intended to file a civil action for negligence, seeking recovery of fire suppression costs and related damages incurred by the Forest Service and its federal and state agency partners.

The settlement includes insurance payments and will be shared among the various agencies involved in fighting the fire.

“we are pleased to have obtained a substantial recovery of costs associated with fighting this fire,” said Crofts. “While nothing can undo the damage that was done to the forest, this settlement sends a message that we are serious about holding those who cause fires accountable.”
