Judge throws out confession in Driggs murder case
7th District Judge Bruce Pickett has granted a defense motion to suppress an alleged murder confession made by Erik Ohlson after he was arrested for driving under the influence. Ohlson, 40, was later charged with two counts of first-degree murder in the shooting deaths of Jennifer Nalley and her unborn child Ohlson was charged July 5, 2016 with DUI, but was not appointed an attorney during his court arraignment. According to court documents, Ohlson was questioned by Idaho State Police detectives later that night, who were investigating the shooting deaths. It was during that interview that Ohlson made incriminating statements to the detectives. Ohlson filed a motion to suppress those statements last December. In his decision Wednesday, Judge Pickett determined that Ohlson’s refusal to answer initial questions should have been recognized as a request for legal counsel. The judge did not throw out statements Ohlson made about Glock pistols while sitting in a deputy’s car. Court records indicate Ohlson initiated a conversation with the deputy in which he voluntarily talked about owning a weapon like the one that was found near the murder scene near Driggs. A status conference on Ohlson’s case is scheduled May 5. A jury trial on the murder charges is currently scheduled July 31.
