Pocatello teacher’s ex-husband pleads not guilty

The ex-husband of the Pocatello teacher accused of sexually assaulting a former student has also pled not guilty.

Appearing before Judge Stephen Dunn Monday, Petersen’s ex, David McGarry, pleaded not guilty to charges of rape and lewd conduct with a child, the same charges his former wife faces.

McGarry and his ex-wife are accused of sexually assaulting one of Tiffany Petersen’s first-grade students in 2008 and 2009, while she was teaching at Washington Elementary in Pocatello.

Though both have pled not guilty, they could face life in prison if found guilty.

McGarry was taken into Bannock County custody Monday, with bail set at $50,000.

A pre-trial date has been set for May 6, with trial set to begin on May 21.
